With the continued recession, employers have been faced with significant challenges to reduce costs. Since personnel accounts for a major proportion of overhead, one possible area of consideration is that of a reduction in the workforce. While reaching and implementing such a decision will, in optimum circumstances, involve significant input from counsel experienced in both employment and labor law issues, even the best-constructed RIF may well be challenged in litigation. This teleconference focuses on the potential areas of challenge; the manner in which the company can respond and, if necessary, defend itself; and special issues regarding electronic discovery, class or collective actions and the unionized workforce. Although the presenter speaks based on a career of representing employers, the lessons to be learned also will be beneficial to attorneys representing individuals, labor organizations and regulatory agencies, as well as human resources professionals.
