Legal Issues in Construction Disputes-Three Key Questions

Over the last 20 years; the construction industry has changed significantly. Different delivery systems have developed making less relevant the traditional design-bid-build structure upon which most construction disputes have been decided. There has also been a substantial effort to use damage waivers and liability limits as a means of controlling "runaway" verdicts. Finally; the current credit crisis has raised the significant possibility of many more project failures than in recent years. This teleconference will address these key issues and discuss practical suggestions for dealing with problem projects in current times.

Learning Objectives:

  • You will be able to identify the scope and schedule of your project.
  • You will be able to explain how the pre-construction process affects the scope.
  • You will be able to discuss the effect of liability limitations.
  • You will be able to recognize if you can stop the slide of a bad project.
