There can be little question in todayÆs world that a thoughtful, well-designed document retention policy is a must for every corporation. Yet many have failed to take this important step to protect their companies. And many more have failed to effectively implement their document retention policies after they have been adopted. The cost of these shortcomings is significant. A corporation may lose significant business information required for on-going business needs. It may also be subjected to civil sanctions, including exclusion of evidence, monetary penalties, adverse inference jury instructions and default judgment, as well as the more serious potential for criminal liability. Indeed, several courts have made clear that a corporationÆs failure to abide by a reasonable document retention policy will not be taken lightly and the risks created by document mishandling and the responsibilities to ensure correct handling will often fall to both inside and outside counsel. This teleconference is designed to help you gain a better understanding of the important factors that must be considered in developing a document retention policy, as well as the role of counsel in relation to the corporationÆs policy once litigation is reasonably foreseeable.
